practical question is straightforward: if the owner died tomorrow, what legal mechanism would move each important asset, to whom would it move, and could the recipient actually take control of it?<\/p>\n<h2 data-section-id=\"po3h6z\" data-start=\"19527\" data-end=\"19555\">What a will normally does<\/h2>\n<p data-start=\"19557\" data-end=\"19636\">A will generally directs assets that form part of the deceased person&#8217;s estate.<\/p>\n<p data-start=\"19638\" data-end=\"19683\">Depending on jurisdiction, these can include:<\/p>\n<ul data-start=\"19685\" data-end=\"19853\"><li data-section-id=\"bz6g3l\" data-start=\"19685\" data-end=\"19711\">\nindividually owned cash;\n<\/li><li data-section-id=\"17l4q5c\" data-start=\"19712\" data-end=\"19734\">\ninvestment data-end=\"20353\">Depending on the form of joint ownership and local law, the deceased person&#8217;s interest may pass automatically to the surviving owner or may become part of the estate.<\/p>\n<p data-start=\"20355\" data-end=\"20396\">The economic asset is identical: a house.<\/p>\n<p data-start=\"20398\" data-end=\"20475\">The succession outcome differs because the legal ownership structure differs.<\/p>\n<p data-start=\"20477\" data-end=\"20619\">Families should therefore record not merely that they \u201cown a London flat\u201d or \u201chave an investment account\u201d, but exactly how accounts and some investment products allow the owner to nominate a beneficiary separately.<\/p>\n<p data-start=\"20766\" data-end=\"20833\">These forms often receive little attention when they are completed.<\/p>\n<p data-start=\"20835\" data-end=\"20988\">Twenty years later, the account may contain substantial wealth while the nomination still reflects an earlier marriage or an outdated family data-end=\"21134\">A large insurance policy still names only the eldest.<\/p>\n<p data-start=\"21136\" data-end=\"21261\">Both documents can operate exactly as intended legally and still produce an overall inheritance the owner no longer intended.<\/p>\n<p data-start=\"21263\" data-end=\"21354\">A serious estate review therefore examines every beneficiary nomination alongside the will.<\/p>\n<h2 need their own succession review<\/h2>\n<p data-start=\"22002\" data-end=\"22101\">Trust assets normally follow the terms of the trust rather than the personal will of a beneficiary.<\/p>\n<p data-start=\"22103\" data-end=\"22155\">That makes trust governance part of estate planning.<\/p>\n<p data-start=\"22157\" data-end=\"22181\">A review should examine:<\/p>\n<ul data-start=\"22183\" data-end=\"22407\"><li data-section-id=\"1378m2c\" data-start=\"22183\" data-end=\"22194\">\ntrustees;\n<\/li><li data-section-id=\"1ooii0a\" data-start=\"22195\" data-end=\"22216\">\nsuccessor trustees;\n<\/li><li data-section-id=\"1b70fqu\" data-start=\"22217\" data-end=\"22233\">\nbeneficiaries;\n<\/li><li data-section-id=\"1337ph\" data-start=\"22234\" data-end=\"22256\">\ndistribution data-start=\"22368\" data-end=\"22407\">\ngovernance after the settlor&#8217;s death.\n<\/li><\/ul>\n<p data-start=\"22409\" data-end=\"22523\">A trust created thirty years earlier may remain legally valid while no longer matching the family&#8217;s circumstances.<\/p>\n<p data-start=\"22525\" data-end=\"22548\">Children become adults.<\/p>\n<p data-start=\"22550\" data-end=\"22579\">Beneficiaries move countries.<\/p>\n<p data-start=\"22581\" data-end=\"22597\">Trustees retire.<\/p>\n<p data-start=\"22599\" data-end=\"22613\">Assets change.<\/p>\n<p data-start=\"22615\" data-end=\"22743\">Estate planning should therefore examine the living structure rather than treating creation of the trust as the end of the work.<\/p>\n<h2 data-section-id=\"1o2l5ua\" data-start=\"22745\" data-end=\"22765\">Letters of wishes<\/h2>\n<p data-start=\"22767\" data-end=\"22866\">A letter of wishes can give trustees context about how the settlor would like discretion exercised.<\/p>\n<p data-start=\"22868\" data-end=\"22964\">Depending on the legal structure, it may not bind the trustee in the same way as the trust deed.<\/p>\n<p data-start=\"22966\" data-end=\"23027\">That flexibility is precisely why the document can be useful.<\/p>\n<p data-start=\"23029\" data-end=\"23180\">The settlor can explain views on education, housing, business support or the circumstances in which substantial capital distributions might make sense.<\/p>\n<p data-start=\"23182\" data-end=\"23276\">A letter that becomes too prescriptive can undermine the purpose of discretionary trusteeship.<\/p>\n<p data-start=\"23278\" data-end=\"23362\">It should guide judgement rather than attempt to recreate the trust deed informally.<\/p>\n<h2 data-section-id=\"v8q6ds\" data-start=\"23364\" data-end=\"23414\">Business succession requires separate decisions<\/h2>\n<p data-start=\"23416\" data-end=\"23537\">Private companies introduce some of the hardest estate-planning questions because ownership and management are different.<\/p>\n<p data-start=\"23539\" data-end=\"23647\">A founder may want three children to benefit economically from a company while only one of them works in it.<\/p>\n<p data-start=\"23649\" data-end=\"23711\">Leaving one third of the shares to each child does not answer:<\/p>\n<ul data-start=\"23713\" data-end=\"23955\"><li data-section-id=\"1cv7qc6\" data-start=\"23713\" data-end=\"23743\">\nWho becomes chief executive?\n<\/li><li data-section-id=\"3gmex6\" data-start=\"23744\" data-end=\"23769\">\nWho appoints directors?\n<\/li><li data-section-id=\"17dlbf0\" data-start=\"23770\" data-end=\"23805\">\nCan one heir sell to an outsider?\n<\/li><li data-section-id=\"1g87ol1\" data-start=\"23806\" data-end=\"23834\">\nHow are dividends decided?\n<\/li><li data-section-id=\"1jy374b\" data-start=\"23835\" data-end=\"23874\">\nWhat happens if one child wants cash?\n<\/li><li data-section-id=\"ovqeri\" data-start=\"23875\" data-end=\"23909\">\nCan the company buy back shares?\n<\/li><li data-section-id=\"95a1y4\" data-start=\"23910\" data-end=\"23955\">\nHow are voting and economic rights divided?\n<\/li><\/ul>\n<p data-start=\"23957\" data-end=\"24048\">The family needs to decide separately who should own, manage and benefit from the business.<\/p>\n<p data-start=\"24050\" data-end=\"24169\">Those answers can then be reflected across the will, shareholder agreements, corporate structure and family governance.<\/p>\n<h2 data-section-id=\"1p9z6vx\" data-start=\"24171\" data-end=\"24195\">Buy-sell arrangements<\/h2>\n<p data-start=\"24197\" data-end=\"24332\">Where several shareholders own a business together, death can leave the surviving owners in business with the deceased partner&#8217;s heirs.<\/p>\n<p data-start=\"24334\" data-end=\"24369\">Neither side may want that outcome.<\/p>\n<p data-start=\"24371\" data-end=\"24465\">A buy-sell agreement can establish what happens to shares after death and how they are valued.<\/p>\n<p data-start=\"24467\" data-end=\"24504\">The arrangement also needs financing.<\/p>\n<p data-start=\"24506\" data-end=\"24660\">An obligation for the company to buy a \u20ac10 million shareholding provides little certainty if the company cannot produce \u20ac10 million when the event occurs.<\/p>\n<p data-start=\"24662\" data-end=\"24764\">Insurance, reserves or financing facilities can therefore become part of business succession planning.<\/p>\n<h2 data-section-id=\"nkpa2k\" data-start=\"24766\" data-end=\"24783\">Digital assets<\/h2>\n<p data-start=\"24785\" data-end=\"24916\">Cryptocurrency has made one estate-planning problem unusually visible: legal ownership is useless when nobody can access the asset.<\/p>\n<p data-start=\"24918\" data-end=\"25034\">A beneficiary might inherit a self-custodied wallet legally while lacking the private keys needed to move the funds.<\/p>\n<p data-start=\"25036\" data-end=\"25088\">There is no bank that can simply reset the password.<\/p>\n<p data-start=\"25090\" data-end=\"25154\">Digital estate planning should therefore separate two questions.<\/p>\n<h3 data-section-id=\"rsexi9\" data-start=\"25156\" data-end=\"25184\">Who has legal authority?<\/h3>\n<p data-start=\"25186\" data-end=\"25288\">The will, trust or other succession arrangement determines who should receive or administer the asset.<\/p>\n<h3 data-section-id=\"1umyi8f\" data-start=\"25290\" data-end=\"25336\">How can that person gain practical access?<\/h3>\n<p data-start=\"25338\" data-end=\"25420\">The owner needs a secure mechanism for passing credentials or activating recovery.<\/p>\n<p data-start=\"25422\" data-end=\"25467\">The same distinction applies more broadly to:<\/p>\n<ul data-start=\"25469\" data-end=\"25658\"><li data-section-id=\"17zu40q\" data-start=\"25469\" data-end=\"25489\">\nexchange accounts;\n<\/li><li data-section-id=\"eh8bcc\" data-start=\"25490\" data-end=\"25510\">\nonline businesses;\n<\/li><li data-section-id=\"dnfw00\" data-start=\"25511\" data-end=\"25521\">\ndomains;\n<\/li><li data-section-id=\"kmeeez\" data-start=\"25522\" data-end=\"25538\">\ncloud storage;\n<\/li><li data-section-id=\"pa2ulo\" data-start=\"25539\" data-end=\"25559\">\npassword managers;\n<\/li><li data-section-id=\"116i7wy\" data-start=\"25560\" data-end=\"25592\">\ndigital intellectual property;\n<\/li><li data-section-id=\"1rynsbs\" data-start=\"25593\" data-end=\"25621\">\nmonetised online accounts;\n<\/li><li data-section-id=\"nnk22p\" data-start=\"25622\" data-end=\"25658\">\ntwo-factor authentication devices.\n<\/li><\/ul>\n<h2 data-section-id=\"13uz9cp\" data-start=\"25660\" data-end=\"25718\">Do not put sensitive credentials casually into the will<\/h2>\n<p data-start=\"25720\" data-end=\"25835\">Wills can eventually become accessible to executors, lawyers, courts or, depending on jurisdiction, public records.<\/p>\n<p data-start=\"25837\" data-end=\"25951\">Putting a cryptocurrency seed phrase directly into the document can therefore create an obvious security weakness.<\/p>\n<p data-start=\"25953\" data-end=\"26083\">The estate plan should tell the authorised person how to obtain access without exposing the credential more widely than necessary.<\/p>\n<p data-start=\"26085\" data-end=\"26201\">Professional custody, multisignature structures or secure recovery systems may be appropriate for valuable holdings.<\/p>\n<h2 data-section-id=\"j6y35r\" data-start=\"26203\" data-end=\"26241\">Incapacity belongs in the same plan<\/h2>\n<p data-start=\"26243\" data-end=\"26363\">Estate planning often focuses on death while overlooking a period in which the owner is alive but cannot make decisions.<\/p>\n<p data-start=\"26365\" data-end=\"26440\">A stroke, accident or cognitive decline can leave someone unable to manage:<\/p>\n<ul data-start=\"26442\" data-end=\"26514\"><li data-section-id=\"xh8807\" data-start=\"26442\" data-end=\"26458\">\nbank accounts;\n<\/li><li data-section-id=\"xb3335\" data-start=\"26459\" data-end=\"26473\">\ninvestments;\n<\/li><li data-section-id=\"1h00bjo\" data-start=\"26474\" data-end=\"26485\">\nproperty;\n<\/li><li data-section-id=\"4hsasj\" data-start=\"26486\" data-end=\"26772\">The principle is universal: succession planning should answer who can act before death as well as what happens afterwards.<\/p>\n<h2 data-section-id=\"r1otrl\" data-start=\"26774\" data-end=\"26786\">Executors<\/h2>\n<p data-start=\"26788\" data-end=\"26843\">Choosing an executor involves more than personal trust.<\/p>\n<p data-start=\"26845\" data-end=\"26869\">An executor may need to:<\/p>\n<ul data-start=\"26871\" data-end=\"27035\"><li data-section-id=\"6lr3mo\" data-start=\"26871\" data-end=\"26887\">\nlocate assets;\n<\/li><li data-section-id=\"1ewpfe4\" data-start=\"26888\" data-end=\"26908\">\nobtain valuations;\n<\/li><li data-section-id=\"gogap4\" data-start=\"26909\" data-end=\"26924\">\nsettle debts;\n<\/li><li data-section-id=\"13p745j\"
